Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you (“you”, “the user”) and FaceyIT FZ-LLC, Ras Al Khaimah, United Arab Emirates (“FaceyIT”, “we”, “us”), governing your use of the Teluma iOS application (“the App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, in accordance with these Terms and the Apple Licensed Application End User License Agreement. You may not copy, modify, reverse-engineer, redistribute, or resell the App except as permitted by law.

2. Teluma is a player, not a content provider

This is the most important thing to understand about the App:

• Teluma does not provide, sell, host, bundle, or supply any television channels, streams, media, or subscriptions to content. The App ships with no content.
• Teluma is a media player. All channels and streams come exclusively from playlist URLs that you add yourself.
• You are solely responsible for the playlists, sources, and content you access, and for ensuring you have the lawful right to access and view that content in your jurisdiction.

3. Acceptable use

You agree that you will not use the App to:

• Access, stream, or distribute any content you are not legally entitled to access, including pirated, infringing, or unauthorized broadcasts.
• Violate any applicable law, regulation, or third-party right, including intellectual-property and broadcasting rights.
• Circumvent access controls or use the App for any unlawful purpose.

Any legal consequences arising from the content you choose to access through your own playlists are your sole responsibility.

4. Subscriptions, free trial and billing

The App may be offered on a subscription basis to unlock playback features. Where subscriptions apply:

• Subscriptions are offered as auto-renewable plans (for example monthly, six-month, and yearly tiers). Current pricing is shown in the App at the point of purchase.
• A free trial may be offered to new users. If you do not cancel before the trial ends, the subscription automatically converts to a paid plan.
• Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• You manage and cancel subscriptions in your App Store account settings, not within the App. Deleting the App does not cancel a subscription.
• Refunds are handled by Apple in accordance with the App Store terms. FaceyIT does not process payments and cannot issue refunds directly.

5. Intellectual property

The App, its name “Teluma”, its logo, design, and software are owned by FaceyIT FZ-LLC and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding. Content accessed through your playlists belongs to its respective rights holders.

6. Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any particular playlist, stream, or third-party service will function, remain available, or be of any given quality. Stream availability and quality depend entirely on your provider and your network.

7. Limitation of liability

To the maximum extent permitted by law, FaceyIT FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App or any content accessed through it. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless FaceyIT FZ-LLC from any claims, damages, or expenses arising out of your use of the App, your playlists and content, or your breach of these Terms.

9. Termination

These Terms remain in effect while you use the App. We may suspend or terminate the license if you breach these Terms. You may terminate at any time by deleting the App. Sections that by their nature should survive termination (including 5–8 and 10) will survive.

10. Apple as third-party beneficiary

This agreement is between you and FaceyIT FZ-LLC only, not with Apple. Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any maintenance, support, and warranty obligations are FaceyIT’s alone, not Apple’s.

11. Governing law

These Terms are governed by the laws of the Emirate of Ras Al Khaimah and the applicable federal laws of the United Arab Emirates, without regard to conflict-of-laws rules. Disputes shall be subject to the competent courts of the United Arab Emirates, subject to any mandatory consumer protections in your country of residence.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the current version, published at teluma.app/terms. Continued use of the App after changes constitutes acceptance.
